Colorado clarifies rules for wage statements, access to records

Colorado has adopted a final rule that clarifies the requirements for wage statements and requires employers to provide access to certain employee records. The final rule takes effect July 15, 2020.


Wage Statements:

The rule clarifies that employers must provide each employee with an itemized earnings statement each pay period that contains the following information:

  • The employee's and the employer's names;
  • Regular rates of pay, gross wages earned, withholdings made, and net amounts paid each pay period;
  • The total hours worked in the pay period; and
  • A record of tips and credits claimed.


Access to Records:

The final rule also requires employers to provide employees with access to the following information:

  • Name, address, occupation, and their date of hire;
  • Daily record of all hours worked.

The employer may choose to provide access to such information in one of the following ways:

  • By including it with the regular wage statements;
  • By furnishing each employee with access to a functioning electronic portal that shows the information (this option is available only if the employer knows the employee's email address); or
  • By providing each employee the information for the entire calendar year by January 31st the following year and once upon request per year.
