FLSA White Collar Exemptions: New Compliance Toolkit and Navigator OT Updates

Author: Jody Rodney/Tuesday, July 12, 2016/Categories: Compliance Corner

Overview.  As you know, recently published regulations impacting the FLSA’s so-called white collar exemptions are effective December 1, 2016.  Attached to this Alert you will find a Compliance Toolkit with all of the latest tools to help you comply with these changes. Also, as a reminder, ADP has partnered with Littler, Compliance HR and Neotalogic to provide you with access to the Navigator OT Application, at no extra cost. The Navigator OT application has – since our clients were first provided access - been updated to conform to the final FLSA regulations.  Please review the details below for more information on the Compliance Toolkit and the Navigator OT updates.

Details. Below you will find additional information about the Compliance Toolkit and Navigator OT updates.

Compliance Toolkit.  In October 2015, Comprehensive Services distributed a “readiness” Toolkit for our employers to leverage to prepare for the upcoming Rule changes.  Since then, employers have received numerous Alerts, Tips, FAQs, Best Practices, a Welcome Kit, a Credentialing Email and sample workforce communications.   The attached Toolkit comprises all of these communications and tools so you have them all in one place and readily accessible.

Navigator OT Update. Users of the application now have the option to review positions under the pre-2016 regulations and under the 2016 regulations by accessing these distinct application versions directly from the user dashboard. The following changes were also made to the new version of the application:

·         The job duties screen now allows a user to enter single percentages instead of ranges making correctly totaling percentages easier.

·         The NAICS code field has been deleted.

·         A "Profession-Specific Exemptions" warning appears on the bottom of the results page notifying end-users that Navigator OT does not review profession specific exemption tests (e.g. for doctors, lawyers and teachers).  Doctors, lawyers, and teachers generally satisfy the requirements for the learned professional exemption but they are not required under the FLSA to be paid on a salary basis.

·         If the evaluation task is assigned to a manager the reviewing manager will no longer automatically receive the evaluation results (only the credentialed user initiating the review can access evaluation results).

As always, please contact your Relationship Manager, or the FLSA Support Team (by calling your 1-800# and selecting the FLSA Support Team option) if you have any questions about the Toolkit or the updates to Navigator OT.
