Virginia Repeals New-Hire Income Withholding Disclosure Requirement

05/03/18

Author: ADP Admin/Tuesday, May 1, 2018/Categories: Compliance Corner

Overview: Virginia repeals the requirement that an employer request that each new employee disclose whether the employee has an income withholding order.

Effective Date: 07/01/2018

Details: Virginia recently repealed the requirement, enacted in 1993, that an employer request that each new employee disclose whether the employee has an income withholding order. This requirement has been superseded in practice by the requirement that an employer submit information about new hires to the Virginia New Hire Reporting Center (https://va-newhire.com/) within 20 days of the employee's hire date.

The new law, SB 51, repeals section 60.2-114.1 of the Virginia Code.

Call to Action: Employers should review and revise, if necessary, their onboarding policies and procedures. Please contact your Service Team with any questions.
