Oklahoma amends its voting leave law

Overview:  Oklahoma has amended its voting leave law by mandating that registered voters are entitled to two hours of paid time off to vote.

Effective Date:  May 6, 2019

Details:

Covered Employee:  An employee that is a registered voter who does not have 3 hours before or after work to vote on election day or day of in person absentee voting.

Amount of Time Off: Employee must be provided 2 hours of paid time off to vote or "sufficient time to cast a ballot."  This time must be provided on election day or on the day of in person absentee voting.  An employer may designate when leave may be taken, and must notify each employee of same.  An employer may change an employee's work hours to provide an employee 3 hours of time in which to vote before his or her shift begins or ends.

Notice Requirements: An employee must provide verbal or written notice 3 days prior to election day or day of in person absentee voting, whichever is applicable.

Employers that fail to comply with the law are subject to a civil penalty between $50 and $100.

Action Required:  Oklahoma employers should review their policies and practices for granting employees time off to vote and complying with related requirements.
