Mississippi Expands Protections for Military Service Members or Veterans While Training

Mississippi’s expanded law provides that military service members and veterans will have reemployment protections when performing duties or receiving training with armed forces of other states.

Effective Date: July 1, 2018

Details: Mississippi law provides employment protections to members of the armed forces and veterans who are called to perform duties or receive training. Specifically, members of any reserve component of the armed forces of the United States or qualified former service members performing duties or receiving training with the United States Armed Forces, the state of Mississippi, or any other state (including active state duty, state-training duty or any other military duty authorized under Title 10 or Title 32 of the United States Code) must be restored to their previous or similar employment position with the same status, pay, and seniority, upon return from duty or training. To be eligible for reinstatement, the service member must provide evidence that the duty or training was completed satisfactorily, and still be qualified to perform the duties of his or her employment position.

These protections do not apply to temporary employment positions.
