Overview. U.S. law requires companies to employ only individuals who may legally work in the United States – either U.S. citizens, or foreign citizens who have the necessary authorization. E-Verify is an internet-based system that allows businesses to determine the eligibility of their employees to work in the United States.
Details. In accordance with the National Archives and Records Administration (NARA) records retention and disposal schedule (N 1-566-08-7), USCIS disposes of E-Verify records that are over 10 years old annually. This minimizes security and privacy risks associated with U.S. government retention of personally identifiable information.
In April 2017, USCIS must dispose of transaction records that are over 10 years old. In order to retain case information, employers using E-Verify may download and save the new Historic Records Report created by USCIS. This report is only available through March 31, 2017. The report contains information, dated on or before December 31, 2006, about each E-Verify case that will be purged.
Call to Action. E-Verify encourages employers to record the E-Verify case verification number on the relating Form I-9, Employment Eligibility Verification, and to retain the Historic Records Report with Form I-9.
