Washington State to Require Electronic Payment of Child Support

Overview: Effective January 1, 2019, many Washington employers will have to remit child support orders electronically. 

Effective Date: January 1, 2019 

Details: Governor Jay Inslee of Washington state has signed into law S6334, which will require employers to remit child support orders electronically as of January 1, 2019, if the employer:
  • has 10 or more employees or 10 or more independent contractors; has received an income withholding order (IWO) for more than one employee or contractor—even if the employer has fewer than 10 employees or contractors; 
  • uses a payroll processor to administer payroll and tax processes, and the payroll processor has the ability to transmit payments via EFT; 
  • or is required to pay certain taxes electronically by the Washington Department of Revenue.

The Washington State Department of Social and Health Services may waive the electronic payment requirement if the employer or payroll processor: (i) does not have a computer that can make electronic payments; (ii) requires additional time to program the computer; (iii) does not currently file data electronically with any other agencies; (iv) has a conflict with business procedures due to compliance; or (v) would suffer financial hardship from compliance.
